Attorney David J. MacMain

David MacMain is a founding member and the managing partner of MacMain Leinhauser PC in West Chester, Pennsylvania. He has broad and extensive trial experience, having tried over 125 cases to verdict in favor of his clients. Over the course of his more than 30-year legal career, David has focused his practice on the defense and counsel of public entities and officials, educational institutions, religious entities, and non-profits throughout Pennsylvania. He counsels and defends clients in a wide variety of government, civil rights, and employment matters including police misconduct, zoning and land use, sexual harassment, discrimination, licensing, First Amendment, corrections, and workplace claims.

A Municipal and Law Enforcement Defense Attorney

David is frequently retained as a consultant and/or lead trial counsel in high-profile §1983 civil rights claims and municipal liability cases throughout the country. In addition to representing government entities, officials, and officers as a municipal and law enforcement defense attorney, he also provides legal counsel to government entities on various operational issues including the review and preparation of policies and procedures.

As a former Pennsylvania State Trooper, David has personal knowledge of the challenges faced by law enforcement and correctional officers and the entities that employ them. He has served as the Solicitor for the Chester County Sheriff’s Department and on the West Chester Civil Service Commission, and he is a member of the Pennsylvania Chiefs of Police Association and the International Association of Chiefs of Police.

David’s extensive legal experience and first-hand familiarity with government and law enforcement organizations and systems allow him to provide practical, high-quality legal representation for the specific needs of clients in these fields as a Pennsylvania law enforcement, employment, and civil defense lawyer.

David MacMain: Professional Involvement and Accolades

David is a member of the Federation of Defense and Corporate Counsel (FDCC), an international organization limited to 1,400 lawyers worldwide who are selected by invitation only following an extensive peer review selection process. He serves as vice chair of the FDCC’s Civil Rights and Public Entity and Trial Tactics, Practice and Procedures Sections. David is also a member of the Association of Defense Trial Attorneys, an invitation-only organization that names one lawyer per one million in population based on their trial skills, where he serves as vice chair of the Diversity and Inclusion Committee.

Also a member of the Defense Research Institute (DRI), David is an active participant in the organization’s Civil Rights and Government Liability, Trial Tactics, and Law Practice Management Committees. He served as the Chair of the Civil Rights and Governmental Liability Committee from 2019 to 2020, was the 2013 Program Director of the annual conference, and has been a featured speaker at many DRI conferences.

David has been selected to Super Lawyers® in the field of Civil Rights in Pennsylvania each year since 2006. This recognition is determined by an anonymous survey of lawyers and judges statewide, and those selected represent the top five percent of all lawyers in Pennsylvania. The Career of Pennsylvania Civil Rights Defense Lawyer David MacMain

After graduating from college, and before beginning his legal career, David served as a Pennsylvania State Trooper stationed at the Avondale, Chester County Barracks where he engaged in all aspects of police work including patrol, accident investigation, and criminal investigation in the 27 municipalities that the Avondale station covered. David worked several jobs to support his family while putting himself through law school at the Temple University School of Law.

David began his legal career with the Philadelphia, Pennsylvania law firm of Montgomery McCracken where he began as a clerk during his final year of law school, worked as an associate for seven years, and was named a partner in 1997. During his eighteen-year tenure at Montgomery McCracken, he served as Chair of the Governmental Liability and Civil Rights Practice Group, Vice Chair of the Insurance Defense Practice Group, and as a member of the firm’s Hiring Committee, Diversity Committee, and Summer Associate Committee.
